Such 'personal' (to the worker) records have to be distinguished from formal agency records. To whom do they belong? What status do the opinions, perceptions, observations and judgements contained in them have? While a hypothesis may be helpful in clarifying the worker's thoughts, when put in writing it may lose its tentative, hypothetical quality and stand as a recorded judgement of a client's personality and behaviour. Can such a record be subpoenaed? Similar concerns may apply to recording in group-care settings.
